Federal authorities has officially joined a lawsuit initiated by California Republicans, seeking to halt the state's recently passed congressional redistricting map.
This legal action, submitted to federal court, challenges the map championed by Governor Gavin Newsom, which was created in reaction against a GOP redistricting effort in Texas.
"The state's redistricting scheme constitutes a blatant attempt to seize control that tramples on voting rights and mocks the electoral system," declared the US attorney general.
Democrats have expressed confidence that the redistricting plan will survive court challenges.
"The plaintiffs lost at the ballot box and they are likely to also lose in court," stated a representative for the governor.
Constitutional Challenge
The legal challenge asserts that California's map improperly used racial considerations to significantly advantage Hispanic voters in contravention of the federal constitution.
"It is unconstitutional to use race as a substitute to advance political interests, but that is exactly what the California General Assembly did with Proposition 50," stated a high-ranking representative from the DOJ's civil rights unit.
Political Context
The legal battle constitutes the most significant response by Democrats in the ongoing redistricting war that began in Texas and has spread across multiple states.
In contrast to elsewhere, where Republican state legislatures have enacted gerrymanders, California's plan required public consent, which it received with nearly 65% of the vote.
Wider Consequences
Democrats need to flip just a small number of Republican-held House seats to take control of the chamber in next year's midterm election.
The party that holds the controlling share will shape the remaining period of the sitting president's term, determining whether a GOP-controlled legislature will continue to deliver its political program or face resistance, congressional probes and possible further challenges.
- Legal representation for the challengers is being provided by a prominent law firm
- The firm's founder currently holds the position of assistant attorney general
- However, this attorney has been removed from the current litigation
